Terms of service

1. The service
TalkHQ provides a voice-receptionist platform: we crawl public information about your business, build a knowledge base, generate a voice agent, and answer the phone for you. By creating an account or using TalkHQ, you agree to these terms.
2. Your account
You're responsible for keeping your login credentials secure. Anyone with access to your password (or your email account, via password reset) can act as you. If you think your account has been compromised, change your password from /dashboard/account and email support@talkhq.com.
One business per account is the default. We may suspend accounts that show signs of fraud or abuse — see §6.
3. Accuracy of business data
Your knowledge base is auto-built from public data and anything you add through the dashboard. You're responsible for keeping it accurate — your hours, your prices, your services. We re-crawl weekly and flag drift, but the final word on what your business does is always yours. If your receptionist tells a caller something wrong because the KB is wrong, the fix is in the KB.
4. Pricing
Current pricing:
- $20 to activate — one-time setup.
- $50/month — base subscription, includes 200 handled minutes.
- $0.10/minute — overage past 200 minutes, billed monthly.
- No contract. Cancel anytime via the Stripe customer portal from your dashboard. Cancellation takes effect at the end of the current billing period.
We may change pricing for future billing periods with 30 days' notice by email. We won't retroactively re-bill periods that have already closed.
5. What you can't do
You agree not to use TalkHQ to:
- Misrepresent the business — if it's not your business, you can't activate a receptionist for it.
- Operate scams, phishing, or impersonation surfaces.
- Accept calls in jurisdictions where doing so violates local law (e.g., regulated industries you're not licensed in).
- Reverse-engineer, scrape, or attempt to bypass the platform.
- Use TalkHQ for outbound spam calling.
6. Suspension and termination
We may suspend or terminate accounts that violate §5, stop paying, or trigger fraud signals (chargebacks, abuse complaints, regulatory takedowns). Suspended tenants stop answering calls immediately; their data is preserved for 30 days during which the owner can resolve the issue and restore service. After 30 days, suspended accounts may be permanently terminated.
You can terminate at any time by deleting your account from /dashboard/account.
7. Service availability
We aim for high uptime but don't guarantee it. Scheduled maintenance, telecom carrier issues, and upstream-AI outages can interrupt service. We don't credit subscription fees for short outages; sustained outages (more than 24 hours in a calendar month) are eligible for proportional credit — email support@talkhq.com.
8. Intellectual property
You own your business data — your KB, your call records, anything we ingest from sources you control. We own the TalkHQ platform itself: the code, the agent architecture, the crawl + generation pipelines. Nothing in these terms transfers ownership in either direction.
9. No warranty, limitation of liability
TalkHQ is provided "as is." We don't warrant that the receptionist will answer every call perfectly or that the KB will always be 100% accurate. Our maximum liability for any claim arising from your use of TalkHQ is limited to the fees you paid in the 12 months preceding the claim. We're not liable for indirect or consequential damages — lost business, missed opportunities, etc. — beyond that.
10. Governing law
These terms are governed by the laws of the State of California, USA. Disputes are handled in the state and federal courts located in San Francisco, California.
11. Changes to these terms
We'll update this page when the substance changes and bump the "Last updated" date at the top. Material changes will also be emailed to active account holders. Continuing to use TalkHQ after a change means you accept the updated terms.
